Learned advocate appearing for the petitioner submits that petitioner is similarly situated as the other accused persons who have been granted bail in CRM (M) 1474 of 2025. Similarly placed other accused persons were subsequently granted bail in CRM (M) 2349 of 2025.
Learned advocate for the State opposes the prayer for bail as other accused persons are absconding. However, it is seen from the records that the petitioners are in custody for about 4 years.
Having regard to the period of detention of the petitioner as also similarly placed other accused persons who
2 have been granted bail, I am of the view further detention is unwarranted.
Accordingly, the prayer for bail of the petitioner is allowed. Petitioner, namely, Joydeb Roy @ Jaydeb Roy @ Jaydev Ray shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned ACJM, Gangarampur at Buniadpur.
If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Dakshin Dinajpur without the prior permission of the learned Trial Court.
Accordingly, CRM (M) 73 of 2026 is allowed.
Leave is granted to the petitioner to amend the cause title.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
