JUSTICE E.S.INDIRESH - 3 - HC-KAR NC: 2026:KHC:16013 WP No. 27774 of 2025 ORAL ORDER In this writ petition, the petitioner is assailing the order dated 07.05.2025 (Annexure–E) passed by respondent No. 2 (Annexure-E), inter-alia, sought for setting aside the Board resolution dated 14.07.2025 passed by respondent No.3 (Annexure–G). 2. I have heard Sri. Jayakumar S. Patil, learned Senior Counsel appearing on behalf for Sri. learned counsel Sri. Sandesh T. B., for the petitioner; Sri. Yogesh D. Naik, learned Additional Government Advocate for the respondent-State and Sri. Shivarudrappa Shetkar, learned counsel for the respondent No.4. 3. Having taken note of the submissions made by the learned counsel appearing for the parties, the learned Additional Government Advocate is justified in submitting that the impugned order passed at - 4 - HC-KAR NC: 2026:KHC:16013 WP No. 27774 of 2025 Annexure–E is appealable under the provisions of the Karnataka Co-operative Societies Act, 1959. 4. In that view of the matter, without expressing any opinion on the merits of the case, I am of the view that, it is open for the petitioner to approach the competent authority for redressal of his grievance by challenging the impugned order. 5. At this juncture, the learned Senior Counsel appearing for the petitioner submitted that this Court has granted an interim order on 12.09.2025, staying the Annexure-E and seeks extension of the same until the petitioner approaches the competent authority. 6. In that view of the matter, I am of the view that the interim order dated 12.09.2025 shall enure to the benefit of the petitioner. In the meanwhile, the petitioner is directed to approach the competent - 5 - HC-KAR NC: 2026:KHC:16013 WP No. 27774 of 2025 authority within four weeks from the date of receipt of a certified copy of this order.
