1. The grievance of the petitioner in the instant Writ Petition is of non-consideration of the petitioner to the post of Principal. According to the petitioner, juniors to him have been promoted particularly the respondents No. 4 to 6. 2. Counsel for petitioner submits that, the petitioner is senior to the respondents No.4 to 6 and till date no adverse entries has been communicated to him so far as his ACR's are concerned. He further submits that, neither the petitioner had been inflicted with any punishment nor enquiry is pending. Petitioner otherwise fulfills all the eligibility criteria for the next promotional post. He submits that, no reasons whatsoever has been assigned by the department for not promoting the petitioner. Petitioner has already made representations (Annexure-P/4 colly.) to the higher authorities in the department which till date have not been decided and therefore petitioner is not in a position to know as to why he has not been promoted. 3.
Given the aforesaid facts and circumstances of the case as also considering the submission of counsel for petitioner that the
3 petitioner fulfills all the eligibility criteria and is also senior to the respondents No. 4 to 6 and representation submitted by the petitioner is to be decided by the competent authority i.e. the respondent No.2, I find it appropriate to dispose of this writ petition permitting the petitioner to submit a fresh representation to be decided by respondents No. 1 & 2. 4. Accordingly, the instant Writ Petition stands disposed off with liberty to the petitioner to make a fresh representation in addition to Annexure-P/4 the representation that he has already made. Upon receipt of such representation, the concerned respondent shall scrutinize the case of the petitioner and shall decide the same at the earliest preferably within a period of 3 months from the date of receipt of representation. 5. The decision of the respondents authorities should be communicated to the petitioner at the earliest thereafter within two weeks. 6. Needless to mention that, in case if the petitioner is found eligible for promotion then necessary orders should be passed within the same period. 7.
