APHC010126862026 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI W.P(PIL). No.63 of 2026 Bench Sr.No:-4 [3552] Elluru Sreeramulu and others ...Petitioners Vs. The State of Andhra Pradesh and others ...Respondents ********** Advocate for Petitioners : Sri Srinivasa Rao Narra Advocates for Respondents : Sri M. Srinivas, learned Central Government Counsel, learned G.P. for Revenue, learned G.P. for Home, Sri P. S. P. Suresh Kumar, learned Standing Counsel for C.B.I. CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE CHALLA GUNARANJAN DATE : 1st April 2026 P C : The issue that has been highlighted in the present petition is with regard to the rampant double registration of properties in gross violation of the provisions of the Registration Act, 1908. 2. It is stated that the registering authorities, invariably for extraneous consideration, allow registration of those properties which have already been the subject matter of sale or lease and have been duly registered. 3. Our attention has been drawn to a communication dated 22.10.2025 written by the District Registrar, Ananthapuramu in which reference is made to 2 various complaints in which fabricated and forged documents were made the basis for registering the properties. 4. On a reading of the said communication, it appears that in all of such cases, the authorities have initiated enquiry proceedings which are stated to be under process. The communication also suggests that a warning has been issued to all the Registering Officers, who, in case they commit any error or irregularity in the registration of the documents in the course of the discharge of their official duties, would be made liable for disciplinary action. 5. A reading of the aforementioned communication also suggests that one Sub-Registrar of Ananthapuramu, based upon a complaint made by one Sri S. Gangadhar, had already been placed under suspension on 03.09.2025. The communication, therefore, does suggest that the authorities in question are not totally silent to the various complaints which have been preferred and filed before the authorities and that action is being taken in that regard. In any case, it can be seen that the cause of action appears to be personal in nature which would give rise to cause of action individual to the person who has suffered on account of any fraudulent registration of documents in regard to the property owned by him. 6. General directions cannot be issued with a view to monitor the various complaints which have been filed since by various complainants in regard to the registrations affected based upon fraudulent documents. It would, however, be appreciated if the Secretary, Revenue and Registration and 3 Stamps Departments and the Director & Inspector General, Registration and Stamps Department take personal interest in ensuring that all such complaints which are filed are taken to their logical conclusion and action is taken strictly in accordance with law with a view to send a clear message that any fraudulent action which is made the basis for getting the documents registered does not go unpunished. In our opinion, no further direction is required. 7. Accordingly, the Writ Petition (PIL) is disposed of. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
