1. Instant writ petition is filed with following prayer:- (i) by an appropriate writ, order or direction the impugned order dated 31.08.2025 issued by the respondents may kindly be quashed and set aside and respondent department be directed to roll back the implementation of the "RAJSSO-AMS" application for recording the daily attendance of
[2026:RJ-JP:11978] (2 of 4) [CW-14979/2025] the employees of Petitioner Samiti of the respondent department, and;
2.
Learned counsel for the petitioner has submitted that the respondents have introduced an attendance management system in the form of a digital application and mandated everyone, by
order dated 31.08.2025, to mark attendance by using the mobile application. Further, he referred the order dated 09.09.2025 in S.B. Civil Writ Petition No. 16724/2025, Ayurved Medical Association, Rajasthan vs. State of Rajasthan & Anr. and submitted that a coordinate Bench, while issuing notice, has
directed the respondents not to take any coercive steps arising out of any alleged violation of not marking presence through the mobile application. He also submitted that the said application will be used only to monitor the employees and the members of the petitioner association, but there are chances of misuse of data. 3. Heard learned counsel for the petitioner and perused the material placed on record. 4. An Aadhaar Enabled Biometric Attendance System (AEBAS) was developed and implemented in the Central Government offices as per OM dated 24.11.2014 issued by DOPT, Ministry of Personnel and Government of India. This service was extended to State Governments and other government organizations. The objective is to facilitate the user to mark their attendance digitally from anywhere through UIDAI registered device by authorized methods like fingerprints, face authentication, IRIS, etc. and facilitate the organization to effective monitor its workforce. 5. An online attendance management system is always beneficial as it is not only most accurate but efficient and cost-
[2026:RJ-JP:11978] (3 of 4) [CW-14979/2025] effective. If there is any issue with any individual, then the same can be raised before the higher officials. The attendance Management system provides minimum information about real- time attendance and gives a real-time monitoring, and features like GPS and geo-tagging allows employer to monitor the employees stationed at remote places. 6. Considering the benefits of online management attendance system and also the endeavor of the Government to deliver good governance, it is necessary to implement online management system. Therefore, the petitioner has no right to challenge the online attendance management system. The petitioner association has failed to show that their members have faced any issue either in

smartphone. 7. Today, we are in digital age and the technology is part of the modern society. In every day, whether it is education, business or healthcare, the technology is playing a vital role. After the Digital India program, Government of India has invested heavily in the digital infrastructure of the country. The moto of the Government is noone is out from benefits of digital revolution. 8. All apprehensions as expressed by learned counsel are just misnomer as either petitioner organization has misunderstood the attendance management system or they with some oblique motive want to continue in the old paper attendance system as they were before.
The apprehension that the technology will be used to monitor the members of the petitioner association is not substantiated by any material. Therefore, the petitioner has no right even for this consideration of this writ petition. [2026:RJ-JP:11978] (4 of 4) [CW-14979/2025]
9. It is not only a frivolous writ petition but an attempt is made just to seek indulgence of this Court on non-existed grounds, therefore the writ petition is liable to be dismissed. 10. In view of discussion made hereinabove, the writ petition is dismissed with pending application, if any. (ASHOK KUMAR JAIN),J GAURAV /151
