1.BAGGI VENKATA PAVAN KUMAR Counsel for the Respondent(S):
1.GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:
“… to issue a Writ order or direction more particularly one in the nature of Writ of Mandamus to declare the action of Respondent No 3 4 in interfering in civil disputes and summoning the petitioners to the Police Station as illegal arbitrary and unconstitutional consequently direct Respondent No 3 and 4 not to interfere with the life and liberty of the petitioners and not to summon them to the police station without following the due process of law and to pass…”
2. Sri Baggi Venkata Pavan Kumar, learned Counsel for the Petitioner submits that the impugned conduct of Respondent No.4, acting at the behest of Respondent Nos.5 and 6, constitutes a manifest abuse of police authority and a flagrant transgression of constitutional guarantees enshrined under Articles 14, 19, and 21 of the Constitution of India. It is submitted that the police, who are vested with powers strictly circumscribed by law, have no jurisdiction to meddle in civil or monetary disputes, and their repeated summons without any FIR or registered crime is in direct contravention of the binding dicta of the Hon’ble Apex Court.
The coercive tactics employed, including obtaining signatures on blank papers, threats of false implication
3 under ‘the SCs/STs (POA) Act’, and attempts to dispossess the Petitioners of their government-allotted dwelling, amount to extortion under the cloak of officialdom and are wholly arbitrary, mala fide, and unconstitutional. The Respondents’ actions, particularly in light of the Petitioner No.2’s precarious medical condition and her subsequent attempt at self-harm due to unbearable harassment, strike at the very root of the right to life and dignity, the present Writ Petition has been filed. 3. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader. 4. Sri P.Ajay Babu, learned Assistant Government Pleader, submits that there is a civil dispute between the Petitioners and the unofficial Respondents. The police have never interfered in such civil disputes. 5. In view of the above, considering the entire facts and circumstances of the case, the Writ Petition is disposed of, directing the Respondents not to summon henceforth the Petitioners to the Police Station unnecessarily and not to interfere with their life and liberty except in strict accordance with due process of law. 6. In the result, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
