The present application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), seeking grant of regular bail in connection with FIR No. 202/2025, registered at Police Station Swaroop Nagar, Delhi, for offences punishable under Sections 309(4), 311 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘BNS’).

Learned counsel for the applicant submits that the applicant was arrested four months after the alleged incident; no Test Identification Parade (TIP) was conducted; and he has been implicated only on the basis of the disclosure statement of the co-accused. 4. present at the spot, no TIP was conducted. However, he is the mastermind of the entire conspiracy; a mobile phone was recovered at his instance, and there are six prior antecedents against him. 5. This Court has heard both the parties. 6. The chargesheet already stands filed, and the mobile phone has been recovered from the applicant, as per the prosecution case. Moreover, he was not present at the spot, as conceded by the learned APP for the State. 7. Keeping in view the facts and circumstances of the case, the applicant is directed to be released on regular bail upon furnishing a bail bond in the sum of Rs. 10,000/- with one surety of the like amount, to the satisfaction of the learned Trial Court/Duty MM, Link Court, subject to the following conditions: i. The applicant shall not leave India without prior permission of the learned Trial Court. ii. The applicant shall intimate the learned Trial Court, by way of an affidavit, and the Investigating Officer regarding any change in his residential address. iii. The applicant shall appear before the learned Trial Court as and when the matter is taken up for hearing. iv. The applicant is directed to provide his mobile number to the Investigating Officer and keep the same operational at all times. v. The applicant shall not, directly or indirectly, tamper with the evidence or attempt to influence the witness in any manner. vi. The applicant shall report at the office of the concerned SHO, PS Swaroop Nagar, Delhi, on the first Monday of every month at 11:00 a.m. and shall be discharged by 12:00 noon, after recording his This is a digitally signed order.
