Hon’ble Shri Justice Rakesh Mohan Pandey Judgment On Board Digitally signed by AJINKYA PANSARE Date: 2026.05.14 14:07:12 +0530 2 14.5.2026 1) Learned Senior counsel appearing for the petitioner submits that petitioner was initially appointed to the post of Assistant Teacher vide order dated 10.3.1984 and he was promoted to the post of Upper Division Teacher vide order dated 10.3.2008. She further submits that petitioner was granted upgraded pay scale from 10.3.1996 after completion of 12 years of service and second upgraded pay scale was extended on 10.3.2008. She contends that according to circulars dated 8.8.2018 (Annexure P/4) and 25.1.2021 (Annexure P/2), petitioner is entitled to receive third upgraded pay scale after completion of 30 years of regular service and petitioner has made representation before respondent No. 3 but same has been rejected vide order dated 21.10.2021. She prays to allow this petition. 2) On the other hand, learned State counsel submits that petitioner was initially appointed to the post of Assistant Teacher ; he was eligible to receive benefit of upgraded pay scale and said benefit was extended twice to the petitioner. He contends that petitioner was promoted to the post of Upper Division Teacher in the year 2008 and thereafter he became entitled to receive time scale pay as per circular dated 10.3.2017. He argues that petitioner has been granted benefit of first time scale pay in year 2018 and since he has retired from services in the year 2019, he is not entitled to receive second time scale pay. He prays to dismiss this petition. 3 3) I have heard learned counsel for the parties and perused the documents placed in the file. 4) During the course of argument, learned State counsel has placed on record a circular dated 10.3.2017 issued by the State which states that Assistant Teachers would not be eligible to receive the benefit of time scale pay ( समयमन वेतनमन) rather they are entitled to receive benefit of upgraded pay scale (्ቅम ्ቐतित). The aforesaid circular also speaks that teachers and lecturers would be eligible to receive benefit of time scale pay after completion of 10 and 20 years of service. 5) In view of the aforesaid discussion, this petition is hereby being disposed reserving liberty in favor of petitioner to make a detailed representation within period of 30 days before Joint Director Public Education Bilaspur Division. It is expected that the authority concerned shall consider and decide the representation, if so moved by the petitioner strictly in accordance with law, preferably within period of 90 days from the date of receipt of copy of such representation. 6) Accordingly, this petition stands disposed.
