02/ 03.07.2026: Heard the learned counsel for the petitioner and the learned counsel for the respondents.
2. By filing this writ petition, the petitioner prays for following relief:
“(i) For quashing of the order dated 06.09.2025/ 14.10.2025 (Annexure- 6/1) passed by the respondent No.5- Circle Officer, Mohanpur in Case Record No.01 of 2025-26, whereby and whereunder the respondent No.5 in pursuance to the order dated 21.05.2025 passed in Revenue Misc. Case No.12 of 2024-25 had cancelled the jamabandi under Section 4h of Jharkhand Land Reforms Act, 1950 existing in favour of Nalini Bala Dutta, bearing jamabandi No.16/2858of Mouza Brahampur, Thana No.586 within P.S. and Circle Mohanpur, District Deoghar. (ii) For quashing of the letter No.1721 dated 09.12.2025 (Annexure-6), issued under the signature of respondent No.5 (Circle Officer, Mohanpur, informed the respondent No.4 (Sub Divisional Officer, Deoghar) with regard to compliance of the order dated 06.09.2025/ 14.10.2025 passed by the respondent No.4 (Sub Divisional Officer, Deoghar) in Case Record No.01 of 2025-26, by cancelling the Jamabandi No.16/ 2858 of Mouza Brahampur, Thana No.586 within P.S. and Circle Mohanpur, District Deoghar, created in favour of Nalini Bala Dutta. (iii) For stay of impugned order dated 06.09.2025 (Annexure-6/A) passed by the respondent No.5 Circle Mohanpur in Case Record No.01 of 2025- 26 as well as the letter No.1721, dated 09.12.2025 (Annexure-6), issued under the signature of the respondent No.5 (Circle Officer, Mohanpur) during the pendency of the present writ application.”

Learned counsel for the petitioner submits that though he has challenged the initial order passed by the Circle Officer, Mohanpur in this writ petition but the petitioner has also challenged the same in an appeal before the Deputy Commissioner, Deoghar.
4. Considering the submission of the petitioner, since the same order has been challenged in an appeal before the Deputy Commissioner, Deoghar, I am not inclined to entertain this writ petition. The petitioner should approach the Deputy Commissioner, Deoghar and pursue his appeal. It is expected that the Deputy Commissioner, Deoghar will decide the same as expeditiously as possible after hearing the parties concerned. If any interim application is filed by the petitioner, the same will also be considered at the earliest.
5. With the aforesaid observations and directions, this writ petition is
disposed of.
