Learned advocate appearing for the petitioners submits that similarly placed accused persons have been granted bail and the petitioner is in custody for 263 days. As such, the petitioners may be released on bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there was recovery of 502 grams of brown sugar from the present petitioners and the total subject-matter of the case is 1391 grams of brown sugar. It has also been submitted that charges have been framed. Having considered that the quantum of contraband involved in the present case attracts Section 37 of the NDPS Act, I am of the view that the petitioner is not entitled to be 2 released on bail. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (NDPS) 149 of 2026, is, thus, dismissed.
