JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks for the following reliefs:- “a) Issue a Writ of Mandamus by directing the Respondents to recalculate the Final score List published on 07.01.2026 vide Annexure – G, as per the negative marking – One mark deduction for every three wrong answers (1/3rd) and publish the same in so far petitioner concern. b) Issue Writ of Mandamus or any other Writ or order or direction directing the respondents to select the petitioner and appoint him to the post of Assistant Engineer (Civil) in the service of the respondent No.1, and grant him all the consequential benefits. c) Grant such other reliefs that this Hon’ble Court deems fit to be grant in the facts and circumstances of the case, in the interest of Justice and Equity.” 2. Heard learned Senior Counsel for the petitioner, learned Advocate General and Senior Counsel for the respondent - 3 - HC-KAR NC: 2026:KHC:18158 WP No. 4441 of 2026 No.1 and learned counsel for respondent No.3 and perused the material on record. 3. Learned counsel for the petitioner submits that the present petition may be disposed of directing respondent No.1 to consider the petitioner to be selected and appointed to the post of Assistant Engineer (Civil) in the service of respondent No.1 by taking the marks of the petitioner as 61 and take appropriate decision/pass appropriate orders in this regard as expeditiously as possible. 4. Per contra, learned Advocate General and Senior Counsel for the respondent submits that if reasonable time is granted, they would consider the request and take appropriate decision / pass appropriate orders in accordance with law within a stipulated period of time. 5. In view of the aforesaid facts and circumstances of the case, I deem it just and appropriate to dispose of the petition by issuing certain directions. In the result, I pass the following: ORDER - 4 - HC-KAR NC: 2026:KHC:18158 WP No. 4441 of 2026 i) The petition is hereby disposed of. ii) Respondent No.1 is hereby directed to consider the request of the petitioner for selection and appointment to the post of Assistant Engineer (Civil) in the service of respondent No.1 by taking the marks secured by the petitioner as 61, if he is otherwise entitled to, and take appropriate decision/pass appropriate orders in this regard in accordance with law within a period of 2 weeks from the date of receipt of a copy of this order.
