22-BA-3824-2026.doc prosecution against unknown persons. No specific or precise role is attributed to the Applicant. The motive for the crime is undoubtedly nothing but gang war and its after-effects, revenge taken by the persons to establish supremacy in their area of operation. There is also an eyewitness whose statement is appended at page 226, but the said statement prima facie does not attribute a specific role to the Applicant in question, save and except to state that an assault was carried out by a group of persons. The previous enmity between the Applicant and the complainant's group, as well as some of the complainant's friends who are already incarcerated in Yerwada Prison, is the reason for the motive attributed by the prosecution to the present crime. 4. The Applicant was arrested on 10/10/2019. He was released on bail thereafter in the year 2020 but was re-arrested in another crime in the year 2024 and has been in incarceration for the past 3 years, excluding the COVID-19 period, otherwise.
In the present crime, the charge is framed; however, the trial has not yet commenced, but there are 47 witnesses cited by the prosecution who are desired to be examined. Considering the ignominy of the trial not having commenced and not being concluded in time, I am inclined to consider the case of the Applicant for the grant of bail. 5. Hence, in view of above prima facie observations and findings, Bail Application of Applicant is allowed subject to the 2 of 4
