Accused No.1 in Crime No.81/2025 registered by Nazarbad Police Station, Mysuru District for the offences punishable under Sections 126(2), 109, 115(2), 351(2), 352 r/w Section 3(5) of BNS 2023 is before this Court in this criminal petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel appearing for the petitioner and learned HCGP on behalf of State. 3. FIR in Crime No.81/2025 was registered by Nazarbad Police Station, Mysuru District initially for the offences punishable under Sections 126(2), 109, 352, 351(2) r/w Section 3(5) of BNS, 2023 against the petitioner herein and two others on the basis of first information dated 22.07.2025 received from Sri. Nagaraju B, who is the injured victim in the present case. Apprehending arrest in the said case, the petitioner had filed Crl.Misc.No.144/2026 before the jurisdictional Sessions Court, which was rejected on 03.02.2026. In the first information submitted by the injured victim he has stated that on 22.07.2025 at about 3.45 p.m, accused no.2 who is the son of the petitioner had fought with him for the reason that he had spoken ill about his father. Thereafter, there was a quarrel between accused persons and the first informant, in which accused no.1 allegedly had assaulted the first informant and caused injury. 5. Undisputedly, the injuries suffered by the first informant (CW1) are all simple in nature. Investigation of the case is completed and charge sheet has been filed. The allegation of assaulting other injured victim, who also have suffered simple injury is only as against accused no.2, who was arrested in the present cases and subsequently released on regular bail. Earlier criminal case were registered against the petitioner prior to the year 2010 and even in the said case, the allegation against the petitioner are not grave. Under these circumstances, I am of the opinion that the prayer made by the petitioner for grant of anticipatory bail needs to be answered affirmatively. - 4 - HC-KAR NC: 2026:KHC:26085 CRL.P No. 3532 of 2026 6. Accordingly, the following:- ORDER The Criminal Petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.81/2025 registered by Nazarbad Police Station, Mysuru District for the offences punishable under Sections 126(2), 109, 115(2), 351(2), 352 r/w Section 3(5) of BNS 2023 subject to the following conditions: 1. The petitioner shall appear before the Investigating Officer in the present case within fifteen days from the date of this order and execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the likesum to the satisfaction of the investigating officer/jurisdictional Court. 2. The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. The petitioner shall not tamper with the prosecution witness and he shall co-operate with the Police for investigation and appear before them whenever called upon. - 5 - HC-KAR NC: 2026:KHC:26085 CRL.P No. 3532 of 2026 4.
