It is the grievance of the petitioners that the Forest Department has entered into the land of the petitioners and they are making some constructions. It is the case of the petitioners that the land belongs to them and they have inherited the same from their ancestors. 3. After hearing the parties and going through the petition, I find that the basic grievance of the petitioners is that the Forest Department had dispossessed the petitioners from a part of the land which the petitioners are claiming. The Forest Department is also claiming their right. Thus, the title of the petitioners, if any, is under cloud. 4. Considering the nature of the dispute which can be decided only after taking evidence, I am not inclined to entertain this writ petition. 2026:JHHC:19065 3 5. The petitioners thus, needs to file a civil suit for declaration of their right, title and interest and also if so advised may pray for interim injunction by filing an application under Order XXXIX Rule 1 and 2 of the CPC. 6. If the petitioners files any application the same should be considered on its own merits as early as possible without being prejudiced by this order. 7.
