By filing this writ application, the petitioner prays to quash the entire proceeding of Misc. Appeal No.12 of 2025 and declare that no appeal lies against orders under Section 48(2)(a) of Co-operative Societies Act, 1935 as it ultra-vires the provision of Section 48(9) of the said Act and the respondent No.3 has no jurisdiction to entertain such appeal. 3. Admittedly, since the petitioner has challenged the maintainability of the appeal, which the Registrar is hearing, I direct the Registrar to decide the question of maintainability within a period of eight weeks after hearing the parties and, thereafter, proceed accordingly. 4. Considering the fact that the petitioner has raised same issue before the Registrar, this writ petition is disposed of with aforesaid direction.
