Learned counsel appearing for the respective respondents jointly submit that the land in question has already been allotted in favour of the petitioner and, therefore, the grievance raised in the present writ petition no longer survives for adjudication. It is contended that, in view of the subsequent developments and allotment having already been made, the present petition has rendered infructuous. 2. Per contra, learned counsel for the petitioner submits that though a portion of the land has been allotted, the entire extent of land claimed by the petitioner has not yet been allotted by the competent authorities. It is further submitted that certain portions of the land are still lying vacant and the petitioner intends to approach the competent authority by filing an appropriate representation/application seeking consideration of his claim over the remaining vacant land. Learned counsel, therefore, seeks permission of this Court to withdraw the present writ petition with liberty to avail such appropriate remedy as may be available under law before the competent authority. 3. Having considered the submissions advanced by learned counsel for the parties, and in view of the prayer made by learned counsel for the petitioner, the present writ petition is dismissed as 3 withdrawn with liberty to the petitioner to file an appropriate application/representation before the competent authority in accordance with law in respect of the land which, according to the petitioner, still remains vacant and unallotted. 4. It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner, and the competent authority shall consider and decide any such application independently and strictly in accordance with law.
