The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.1099/2025 registered at Police Station – Sarkanda, District -Bilaspur (C.G.) for the offence punishable under Sections 296, 351(2), 115(2) and 109 of Bharatiya Nyaya Sanhita, 2023. 2. The prosecution case, in brief, is that the prosecution story in brief is that, as per the FIR lodged by one Dipendra Khande on 11.08.2025, it is alleged that on the night of the said date at about 10:00 PM, near Chilhati Bridge within the jurisdiction of Police Station Sarkanda, an altercation took place wherein the present applicant allegedly threatened the PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.05.15 17:43:04 +0530 2 complainant and caused injuries to one Sanjay Khande, the paternal aunt’s son of the complainant, who had intervened in the matter. On the basis of the said report, Crime No. 1099/2025 was registered against the present applicant at Police Station Sarkanda for offences punishable under Sections 296, 351(2), 115(2) and 109 of the Bharatiya Nyaya Sanhita (BNS). 3. It is argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. He further submits that the applicant is alleged to have caused injuries to the injured, Sanjay Khande, by a vegetable knife. It is also submitted that, as per the MLC report, the injured sustained injuries on the abdomen. Learned counsel further submits that the applicant has no previous criminal antecedents. The charge-sheet, along with the injury report, has already been filed in the case. The applicant is in jail since 11.08.2025 and the trial is likely to take a considerable time for its conclusion. Therefore, he prays for grant of bail. 4. On the other hand, learned State counsel opposed the bail application, and submits that that the injuries caused to the injured, Sanjay Khande, by the knife were found to be grievous in nature and inflicted on his abdomen. Therefore, it is submitted that the applicant is not entitled to be released on bail. 5. I have heard learned counsel for the parties and perused the documents available on record. 6. Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and the fact that, the injuries caused to the injured, Sanjay Khande, by the knife were found to be grievous in nature and inflicted on his abdomen, further the 3 charge-sheet has already been filed in the present case, and the applicant has been in judicial custody since 11.08.2025, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of the applicant - Amarjeet Ratre @ Bhola involved in Crime No.1099/2025 registered at Police Station – Sarkanda, District - Bilaspur (C.G.) for the offence punishable under Sections 296, 351(2), 115(2) and 109 of Bharatiya Nyaya Sanhita, 2023, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
