Ajay Mohan Goel, Judge (Oral) By way of this petition, the petitioner has, inter alia, prayed for the following reliefs:- “a) Issue a writ in the nature of Certiorari for quashing and setting aside the impugned transfer order/notification dated 05.03.2026 (Annexure P-1), whereby the petitioner has been transferred from his present place of posting to CMU Division, Bilaspur, being arbitrary, illegal and contrary to the Transfer Policy as well as the directions earlier issued by this Hon'ble Court; b) Issue a writ in the nature of Mandamus directing the respondents to allow the petitioner to continue at his present place of posting till his retirement on 31.08.2026, in view of the policy protection available to employees nearing retirement and in the absence of any genuine public interest warranting his displacement; c) Pass an interim order, during the pendency of the present writ petition, staying the operation and implementation of the impugned transfer order dated 05.03.2026 (Annexure P-1), and directing the respondents 1 Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:35550 not to relieve the petitioner from his present place of posting; d) Pass any other or further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, in the interest of justice.” 2. On 09.03.2026, the operation of impugned Notification stayed. Learned Counsel for the petitioner informs the Court that the petitioner is to superannuate on 31.08.2026. 3. In light of this development, this petition is disposed of by quashing Notification dated 05.03.2026 (Annexure P-1), qua the petitioner. The petitioner shall be allowed to superannuate from his present place of posting. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
