2. The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter, ‘BNSS’) seeking quashing of FIR No. 257/2022, registered at P.S. M.S. Park, Delhi, for offences punishable under Sections 498A/406/323/354/506/509/34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’) and Section 4 of the Dowry Prohibition Act, 1961, along with all consequential proceedings arising therefrom, on the basis of a settlement arrived at between the parties.

4. The petitioners are present in Court. Respondent No.2 is present through video conferencing and has been duly identified by her counsel as well as by the Investigating Officer (IO) concerned. The brother of Respondent No.2 is also present in Court.

Learned counsel for the petitioners submits that the parties have amicably settled all their disputes vide Settlement Deed dated 30.04.2024. It is submitted that the total settlement amount was fixed at Rs.6,00,000/- (Rupees Six Lakhs only), out of which Rs.4,00,000/- has already been paid to Respondent No.2 and the balance amount of Rs.2,00,000/- is being handed over to the brother of respondent no.2 in Court today by way of Demand Draft bearing No. 099993. It is submitted that, upon payment of the said amount, the settlement stands fully complied with.

On a query by the Court, Respondent No.2, who is present through video conferencing and has been duly identified by her counsel as well as the IO, states that she has entered into the settlement voluntarily and out of her own free will, without any force, coercion or undue influence. She further states that she has no surviving claim or grievance against the petitioners and has no objection to the quashing of the FIR and the proceedings emanating therefrom.
7. It is further submitted that the marriage between Petitioner No.1 and Respondent No.2 has already been dissolved by a decree of divorce by mutual consent dated 21.03.2025 passed by the learned Family Court, Shahdara District, Karkardooma Courts, Delhi.

In view of the settlement arrived at between the parties, the payment of the entire settlement amount and the categorical statement of Respondent No.2 that she has no objection to the quashing of the FIR, continuation of the This is a digitally signed order. criminal proceedings would serve no useful purpose.
9. Accordingly, FIR No. 257/2022, registered at P.S. M.S. Park, Delhi, for offences punishable under Sections 498A/406/323/354/506/509/34 IPC and Section 4 of the Dowry Prohibition Act, 1961, along with all consequential proceedings emanating therefrom, is hereby quashed.
10. The present petition, along with pending application(s), if any, stands
disposed of.
11. Copy of the order be communicated to the concerned learned Trial Court for necessary action and compliance.
