D.NO. 74-7-6/2, DONKA ROAD, PATAMATA, VIJAYAWADA, NTR DISTRICT, ANDHRA PRADESH - 520010 ...RESPONDENT(S): Counsel for the Petitioner(S): SRINIVASULU P Counsel for the Respondent(S): GP FOR HOME 3 Dr. YLR, J W.P.No.8841 of 2026 Dated 06.04.2026 The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue Writ or Order or direction more particularly in the nature of WRIT OF MANDAMUS by declaring the inaction of the respondents to register the reports given on different dates against the respondents 6 to 10 for the continuous criminal offences committed against the person and property of the petitioners 1 and 2 and consequently to direct the respondents to register the crime and investigate and consequently to act upon legally as per procedure contemplated under the provisons of BNSS and to direct the respondents to give protection to the lives of petitioners and to their property and to pass….” 2. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader. 3. Sri P. Srinivasulu, learned counsel for the petitioners, submits that, despite submitting several representations and complaints to respondent Nos.3 to 6, they were not registered as FIRs. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the respondent police have conducted a preliminary enquiry and noticed that the entire nature of the transactions is civil in nature and that no cognizable offences were committed. Therefore, the police have not taken any action. 5. Be that as it may, the petitioners have an alternative efficacious remedy by filing a complaint before the learned jurisdictional Magistrate under Section 190 read with Section 200 of ‘the Cr.P.C.,’/Section 210 read with Section 223 4 Dr. YLR, J W.P.No.8841 of 2026 Dated 06.04.2026 of ‘the BNSS’, in case the complaints of the petitioners are not registered as FIRs. 6. Considering the entire facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, requiring the petitioners to approach the learned jurisdictional Magistrate by way of filing an appropriate complaint under Section 190 read with Section 200 of ‘the Cr.P.C.,’/Section 210 read with Section 223 of ‘the BNSS’, if so advised. 7. With the above observations and directions, the Writ Petition is disposed of. There shall be no order as to costs.
