Accused Nos.1, 2 and 5 in Crime No.41/2025 registered by Madhugiri Police Station, Tumakuru, for the offences punishable under Sections 115(2), 118(1), 118(2), 351(2), 352 and 3(5) of BNS, 2023, are before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.41/2025 was registered by Madhugiri Police Station, Tumakuru, initially for the offences punishable under Sections 115(2), 118(1), 352, 351(2) and 3(5) of BNS, 2023, against Gowtham and others based on the first information dated 20.03.2025 received from Shree Harsha B M, - 3 - HC-KAR NC: 2026:KHC:26260 CRL.P No. 5780 of 2026 who is one of the injured victim in the alleged incident in question. CW1 - Shree Harsha B M, has suffered only simple injuries and CW2 - Srinivasa S, has suffered 4 injuries and out of the said injuries, only injury No.2 is said to be grievous in nature. The allegation of causing said injury is as against accused No.2 - Jafar. Investigation of the case is completed and charge sheet has been filed. Charge sheet material would go to show that, Jafar has cooperated with the police for the purpose of investigation and his statement was also recorded by police on 22.04.2025. There are no serious allegations against the other accused. Considering the said aspect of the matter, I am of the opinion that the prayer made by the petitioners for grant of anticipatory bail needs to be answered affirmatively. Accordingly, the following:- 4. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.41/2025 registered by Madhugiri Police Station, Tumakuru, for the offences punishable under Sections 115(2), 118(1), 118(2), - 4 - HC-KAR NC: 2026:KHC:26260 CRL.P No. 5780 of 2026 351(2), 352 and 3(5) of BNS, 2023, subject to the following conditions: 1. The Petitioners/accused Nos.1, 2 and 5 shall appear before the jurisdictional Court within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the jurisdictional Court. 2. Petitioners/accused Nos.1, 2 and 5 shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioners/accused Nos.1, 2 and 5 shall not tamper with the prosecution witnesses and they shall co-operate with the police for investigation and appear before them whenever called upon. 4.
