This application is directed against the Judgment dated 19.06.2017, passed in Criminal Appeal No. 51 of 2015, by the learned Additional Sessions Judge- V, Jamshedpur, whereby and whereunder, the Judgment and order of conviction and sentence dated 21.04.2015 passed in C/1- Case No. 1878 of 2009 by the learned Judicial Magistrate 1st Class, Jamshedpur convicting the petitioner for the offence u/s 138 of the N.I. Act and sentencing him to undergo S.I. for four months along with compensation amount of Rs. 40,000/- has been affirmed. Submission has been advanced by Mr. Lukesh Kumar, learned counsel for the petitioner that the matter has been compromised between the parties and the entire amount has been returned back to the opposite party no. 2. In support of such contention, learned counsel has referred to the Joint Compromise Petition which is contained in I.A. No. 7232 of 2026. Mr. Fiaj Alam, learned counsel appearing for the opposite party no. 2 has accepted the factum of compromise and has also accepted the fact that the entire amount has been received by the opposite party no. 2. Regard being had to the fact that the matter has been compromised between the parties as would be evident from the averments made in I.A. No. 7232 of 2026, this Cr.
