Heard the parties.
The petitioner has been made accused in connection with Sahibganj P.S. Case No. 49 of 2023 registered for the offence punishable under Sections 147, 148, 149 and 302 of the I.P.C. and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the allegation against the petitioner was a member of an unlawful assembly and in prosecution of common object committed murder of brother of the informant namely Ravindra Yadav. It is submitted that the allegation against the petitioner is false. It is further submitted that there is specific allegation against Sunil Yadav @ Nanua @ Shankar Yadav of firing upon the back of the Ravindra Yadav. It is next submitted that the petitioner is not named in the F.I.R. and the petitioner has been implicated only on the basis of confessional statement of co-accused persons namely Lala Yadav and Nitish Kumar Yadav @ Gudar Yadav who have already been admitted to bail by the Co-ordinate Bench of this court vide orders dated 31.07.2024 in B.A. No. 3069 of 2024 and in B.A. No. 4017 of 2024. It is then submitted that except the confessional statement of the co-accused persons there is no other material to implicate the petitioner in this case. It is next submitted that the petitioner undertakes that he will co-operate with the trial of the case and will not annoy or disturb the informant or
witnesses of the case. It is lastly submitted the petitioner has been in custody since 13.05.2026 as mentioned in para-01 of the bail application and though charge-sheet has been submitted but no witness has been examined. Hence it is submitted that the petitioner be released on bail.
Learned A.P.P. assisted by learned counsel for the informant vehemently opposes the prayer for bail.
Considering the facts of this case, the above-named petitioner is
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. in connection with Sahibganj P.S. Case No. 49 of 2023 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the informant or witnesses of the case in any manner during the trial of the case.
