By filing this writ petitioner, the petitioner prays for quashing and setting aside the impugned E-Auction Sale Notice dated 02.01.2026 (Annexure-4) issued by the respondent No.1 under Section 13(4) of the SARFAESI Act, 2002 read with proviso to Rule 8(6) of the Security Interest (Enforcement) Rules, 2002 in respect of mortgaged immovable property. 3. Mr. P.A.S. Pati, learned counsel for the respondent-Bank at the very outset objects on the filing of this writ petition on the ground that the petitioner should approach Debt Recovery Tribunal, Ranchi. He submits that earlier no Presiding Officer was appointed but now additional charge of Debt Recovery Tribunal, Ranchi has been given to Shri Anil Kumar Gupta, P.O., Debt Recovery Tribunal, Ahmedabad, who is regularly holding the court virtually and he is also taking up the urgent matters. 4. Considering the said submission, I direct the petitioner to approach the Debt Recovery Tribunal, Ranchi by filing an appropriate application. After filing an application, it will be open to the petitioner to mention the urgency before the Debt Recovery Tribunal, Ranchi, who can take up the matter and dispose of the same at the earliest either in virtual mode or physical mode. 5.
