JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners are before this Court calling in question the proceedings in C.C.No.94/2025 (Crime No.408 of 2024) registered for the offences punishable under Sections 115(2), 126(2), 351(2), 351(3), 352 and 3(5) of the BNS, 2023. 2. During the pendency of the proceedings, the parties to the lis have settled the dispute amicably amongst themselves. A joint affidavit is also filed by both the parties in this regard wherein one such condition is closure of the present proceedings. The joint affidavit reads as follows: “We, Shashikumari D.M., W/o. Umesh N., aged about 35 years, residing at No. C2323, Brigade Meadows, Uttarahalli Hobli, Bengaluru South, Bengaluru and Subramanya A.M. S/o. Late Sri. AS Manjunathaiah, aged about 52 years, Pankaj Yadav, S/o. Bhragunath Yadav and Satyanarayana, S/o. Late Sri. Hanumanth Rao, all R/a. Brigade Meadows, Uttarahalli Hobli, Bengaluru South, - 4 - HC-KAR NC: 2026:KHC:25746 WP No. 8984 of 2025 Bengaluru do hereby solemnly affirm and state on oath as under: 1. We state that on account of intervention of elders and well-wishers, the matter between us has been settled. Accordingly, we do not intend to prosecute the proceedings in CC No. 94/2025 before the II ACJM, Bengaluru Rural. 2. We state that the charge sheet was filed against the Petitioners for the offences under Sections 115(2), 126(2), 351(2), 351(3), 352 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023. The dispute between us arose out of misunderstanding and personal differences. With the intervention of elders, friends and well-wishers, we have amicably resolved all disputes and differences between ourselves. 3. We submit that the settlement has been entered into voluntarily, out of free will and without any force, coercion or undue influence from any quarter. 4. In view of the amicable settlement, the offences punishable under Sections 115(2), 126(2), 351(2), 351(3), 352 read with Section 3(5) of BNS, being compoundable offences, we request that the proceedings in CC No. 94/2025 before the II ACJM, Bengaluru Rural be quashed. 5. The complainant further submits that she has no objection for closure of the proceedings against the accused persons and undertakes to cooperate for disposal of the matter in accordance with law.” 3. Since the offences alleged against the petitioners are not against the State or the Society, and in the light of the settlement arrived at between the parties as aforesaid, I deem - 5 - HC-KAR NC: 2026:KHC:25746 WP No. 8984 of 2025 it appropriate to obliterate the proceedings pending against the petitioners. 4. For the aforesaid reasons, the following: ORDER (i) Writ Petition is disposed. (ii) Impugned proceedings in C.C.No.94/2025 pending before the II Additional Chief Judicial Magistrate, Rural Court, Bengaluru stand quashed qua the petitioners.
