p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No. 353 of 2026 Siphan Kumar Khora …. Petitioner Mr. S.K. Jena, Advocate -Versus- State of Orissa …. Opposite Party Mr. S. Panda, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 19.01.2026 01. 1. Heard learned counsels for the respective parties. 2. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with G.R. Case No.22 of 2024 pending in the file of learned J.M.F.C, Dasamantpur arising out of Dasamantpur P.S. Case No.20 dated 3rd February, 2024 on the grounds stated. 3. The mischief has been allegedly committed by the accused persons described in detail in the FIR at Annexure-1. It is claimed that the petitioner’s name is not mentioned in the FIR. The allegation is to the effect that the accused persons committed the mischief in respect of cash and other articles removed from the shop of the informant. Learned counsel for the State submits that an amount of Rs.8000/- was taken away from the alleged shop. One of the accused persons named in the FIR is on bail. In respect of the co-accused, namely, Debashisa p. 2 Khara @ Sonu Khara, plea for anticipatory bail was rejected in ABLAPL No.2154 of 2024. Considering the above facts and since, the petitioner is similarly situated like the co-accused persons even though his name has been mentioned in the FIR i.e. Annexure-1, the Court is not inclined to grant him pre- arrest bail but directs for him to surrender before the court of learned J.M.F.C, Dasamantpur seeking regular bail and in the event of rejection, to move the learned Sessions Court during the second hours for orders. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction to the petitioner to surrender before the court of learned J.M.F.C, Dasamantpur in connection with G.R. Case No.22 of 2024 corresponding to Dasamantpur P.S. Case No.20 within a fortnight from today and in the event, an application seeking regular bail is moved by him, the learned J.M.F.C. shall be consider it during the first hour considering the plea of parity and in the event of rejection, he shall have liberty to approach the learned Sessions Court for orders during the second hour of the same day. 6.
