This Petition arises out of the order dated 8th August, 2016 passed by the Maharashtra Administrative Tribunal, Mumbai in Original Application No.1047 of 2015 whereby the Respondent herein has challenged his disqualification for being appointed to the post of Daphtar Karkoon, Canal Inspector and Measurer on the ground that he had not obtained the certificate of MS-CIT. By the impugned order, the learned Tribunal has remanded the matter to the Department of Water Resources to take a decision by referring to the relevant Government Resolutions. However what we find is that, in the meantime, more than ten years have lapsed. In all probability, the Respondent might have retired from service. 1/2 24-WP-10159-2017.doc Dixit 2. The learned counsel appointed through Legal Aid Panel representing the Respondent does not have any instructions on the above. However, from the material on record, we find from the pleadings in Original Application filed before the Tribunal, the age of the Petitioner was recorded as 49 years in 2015. If that be so, in all likelihood the Petitioner must have retired from service. In view thereof, the claim of the Petitioner to the post in question may not survive at this point of time.
