By way of this petition, the petitioner has prayed for the following relief: “a) That a writ in the nature mandamus may kindly be issued and directing respondents to give appointment letter to the petitioner and he be allowed to join as PGT Economics with his seniority and eligibility as recommended by respondent No.2 earlier panel list and one post is lying vacant under ex-service mean quota in general category.” 2. In terms of the reply that has been /led by respondent No. 2, the petitioner was initially registered with the said respondent 1 Whether reporters of the local papers may be allowed to see the judgment? as a general category candidate, but thereafter in the year 2020, the petitioner got his category changed from General to OBC. It is further mentioned in the reply that after transferring the name of the petitioner from general category to OBC category, his name stood re1ected at Sr. No. 1 of the waiting panel 2020 under OBC category for the post of PGT Economics. However, since 2021, as no vacancy of PGT Economics for OBC category has been received till the time of /ling of the reply, therefore, his name had not been sponsored, and as and when vacancy request was received against the post of PGT Economics, petitioner would be accordingly nominated on priority for the post of PGT Economics. 3. In the light of this reply, Mr. Javed Khan, learned counsel for the petitioner submits that respondents be directed to ensure that as and when a demand for /lling up a post of PGT Economics is received by respondent No. 2, it will forthwith sponsor the name of the petitioner because the said respondent cannot now be permitted to resile from the fact that the petitioner, since the year 2021, is at serial number 1 in the waiting panel of OBC category. …2…( 2026:HHC:33469 ) 4. In the light of the reply /led by respondent No. 2, as the request made on behalf of the petitioner is a genuine request, this petition is disposed of with the direction that as and when a requisition is received by respondent No. 2 qua a post of OBC category of PGT Economics, the name of the petitioner be sponsored in the light of the contents of para-2 of the reply, in terms whereof he is at serial number 1 of the waiting panel of OBC category candidate for the post of PGT (Economics). 5.
