Order 13/02/2026
1. The petitioner-State of Rajasthan has filed this writ petition, feeling aggrieved by order dated 12.07.2024 passed by Rajasthan Civil Services Appellate Tribunal, Jaipur in Appeal No.2135/2024, whereby order dated 25.06.2024 earlier passed by State Project Director-cum-Commissioner, Rajasthan School Education Council has been quashed.
2.
Learned counsel submits that original posting of respondent-Ghanshyam Singh Gurjar was at the office of Chief Block Education Officer, Simalwara, District Dungarpur, however, only for the purpose of working arrangement at Dausa and vide
order dated 25.06.2024, the respondent was again posted at
[2026:RJ-JP:7097] (2 of 2) [CW-15680/2024] Simalwara, Dungarpur. Learned counsel submits that such order dated 25.06.2024 has wrongly been treated as transfer order by the Tribunal and has committed serious error of law in quashing the order by narrating it to be transfer order.
3.
Learned counsel for the respondent opposed the writ petition and submitted that learned Tribunal has passed order dated 12.07.2024 after duly appreciating facts of the case, material on record and law prevailing at the relevant time, there is no scope of interference in the instant writ petition. The petitioner was illegally transferred in the name of officiating arrangements vide order dated 25.06.2024, hence, such order has rightly been quashed by the Tribunal.
4. Heard learned counsel for the parties and perused the record.
5. It has not been disputed by learned counsel for the parties that even if the order dated 25.06.2024 has been quashed by the Tribunal for the reasons assigned in the order dated 12.07.2024, it would not preclude the State Government from passing any order subsequent thereto strictly in accordance with law. Since, as per the administrative exigency, the State Government can post any of its employees as per the requirement, therefore, in the light of such liberty, no interference is called for in order dated 12.07.2024 and the writ petition filed by the petitioner is hereby dismissed.
6. Pending application(s), if any, stand(s) disposed of.
