1. SIVA RAMA KRISHNA KOLLURU The Court made the following:
3
THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL REVISION CASE NO: 249/2024
ORDER:
No representation on behalf of the petitioner. Since it is a Criminal Revision Case, this Court is inclined to proceed with the matter and decide the issue on merits.
2. This Criminal Revision Case is filed under Sections 438 and 442 of the Bharatiya Nagarik Suraksha Sanhita, seeking to set aside the order dated 24.01.2024 passed in Crl.M.P. No.132 of 2023 in F.C.O.P. No.33 of 2023 on the file of the learned Family Court – cum – XII Additional District Judge, Guntur, whereby the petition filed under Section 125 Cr.P.C. was allowed, directing the petitioner to pay interim maintenance of Rs.5,000/- per month to the respondent herein.
3. The record would show that the husband is earning gross salary of Rs.33,014/- and net salary of Rs.27,567/- per month. The respondent denied the same and disputed his income. The learned Family Court, upon considering the material on record and the needs of the petitioner, granted interim maintenance of Rs.5,000/- per month.
4. Upon perusal of the material available on record, this Court finds that the impugned order does not warrant any interference in revision. The learned Judge has exercised discretion judiciously based on available material.
4
5. Accordingly, the Criminal Revision Case is dismissed. However, both parties are at liberty to raise all their contentions before the learned Family Court during the course of enquiry. The learned trial Judge shall decide the matter independently, in accordance with law, without being influenced by any observations made in this order. The learned trial Judge is directed to dispose of the F.C.O.P. No.33 of 2023 as expeditiously as possible, preferably within a period of two (2) months from the date of receipt of a copy of this order, as the main case pertains to the year 2023. Miscellaneous petitions pending, if any, shall stand closed.
