Affidavit of service filed in Court today is taken on record. The petitioner states that an award has been declared in the name of the predecessor-in-interest of the petitioner but no compensation amount has been disbursed in favour of the predecessor-in-interest of the petitioner till date. Mr. De, learned Additional Government Pleader disputes such submission of the learned advocate for the petitioner. He submits that the payment notice was issued in the name of the awardee and in spite of such fact the awardee or his successor did not approach the authorities to receive the compensation amount. The learned advocate appearing for the petitioner submits that the notice was addressed to a dead person.

After some argument, the learned advocate for the petitioner submits that the grievance of the petitioner has not been correctly reflected in the representation dated December 12, 2022. He prays for leave to file a fresh representation and for a direction upon the authorities to consider the same within a stipulated time limit. Mr. De, learned Additional Government Pleader does not dispute such submission of the learned advocate for the petitioner. In the light of the submissions made by the learned advocate for the petitioner, WPA 2622 of 2026 stands
disposed of by giving liberty to the petitioner to submit a comprehensive representation before the Special Land Acquisition Officer (General), being the respondent No.3 and if such a representation is submitted such authority shall consider and dispose of the same by passing a reasoned order as expeditiously as possible but positively within a period of 8 weeks from the date of receipt of a server copy of this order along with a copy of the representation permitted to be submitted pursuant to this
order. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
