THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 2423 OF 2026 ORDER:- The Criminal Petition has been filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.’)/ Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.7 on bail in Crime.No.78 of 2025 of Gangavaram Police Station, Alluri Sitharama Raju District, registered against the Petitioner herein for the offences punishable under Section 8(c) read with Section 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. Heard Mr. G.Sree Vatsav, learned counsel for the petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing the respondent/State. Perused the record. 3. This is the 2nd bail application. Earlier this Court dismissed the bail application filed by the petitioner vide Crl.P.No.738 of 2026, dated 09.02.2026. 4. The learned Assistant Public Prosecutor on behalf of the State would submit that there is no change of circumstances from the date of dismissal of the 1st bail application in Crl.P.No.738 of 2026, dated 09.02.2026. She would further submit that the investigation is at nascent stage, inventory is not

completed and the petition seeking for custodial interrogation was filed by the police before the learned Court below, which is pending for orders. The contraband involved in the present case is in large quantity i.e., 900 kgs ganja, which is a commercial quantity. She finally submits that the petition is liable to be dismissed. 5.
Considering the nature and gravity of allegation levelled against the Petitioner, his alleged role played in this case and there is no change of circumstances from the date of dismissal of the 1st bail application in Crl.P.No.738 of 2026, dated 09.02.2026 and also petition seeking for custodial interrogation was filed by the police before the learned Court below, which is pending for orders, this Court is not inclined to enlarge the Petitioner on bail at the present time. 6. In the result, the Criminal Petition is dismissed. As a sequel thereto, the interlocutory applications, if any, pending in the Criminal Petition shall stand closed. __________________________________
