The petitioner has filed this petition seeking the following relief(s):- “10.1 That, the Hon’ble Court may kindly be pleased to quash the order dated 29.10.2021 (Annexure P-1) passed by respondent no. 4 being illegal arbitrary and without any authority of respondent no. 4, in the interest of justice. The facts, in brief, are that the substantive post of the petitioner is Teacher (LB) who was posted at Government Higher Secondary School, Pinkapar, Block Chhuriya, District Rajnandgaon (C.G.). The petitioner was given additional charge of Cluster Academic Coordinator in Government Middle School, Lalutola, but subsequently the additional charge of Cluster Academic Coordinator was withdrawn by the District Education Officer (DEO), Rajnandgoan vide order dated 29.10.2021 and against said order, this petition has been preferred. 3. Learned counsel appearing for the petitioner would submit that the additional charge of Cluster Academic Coordinator has been withdrawn pursuant to a complaint made against the petitioner. He would contend that no opportunity of hearing was afforded to the petitioner and therefore, the order is bad-in-law. 4. On the other hand, learned counsel appearing for the respective respondents would oppose. They would submit that 03 Members Committee was constituted to enquire into the allegations, wherein the allegations were found proved that the petitioner campaigned in support of his mother for office of Councilor of Nagar Panchayat and therefore, said decision was taken on account of administrative exigency. They would further submit that pursuant to interim order, the petitioner is still officiating as Cluster Academic Coordinator in Government Middle School, Lalutola. They would submit that the petition deserves to be dismissed. 3 5. I have heard learned counsel for the parties and perused the documents. 6. Taking into consideration the fact that the petitioner was not afforded an opportunity of hearing and enquiry was conducted by 03 Members Committee behind the back of the petitioner, therefore, order Annexure P/1 dated 29.10.2021 is hereby quashed. 7. The District Education Officer, Rajnandgaon shall provide an opportunity of hearing to the petitioner within period of 15 days from the date of receipt of copy of this order and take decision within further period of 15 days. The entire exercise shall be completed within further period of 30 days. The interim order dated 29.11.2021 shall continue for period of 30 days only. 8.
