The instant Civil Miscellaneous Petition has been filed for restoration of civil miscellaneous petition being C.M.P. No. 89 of 2019, which stood dismissed on 01.02.2024 for non- compliance of order dated 25.01.2024. 2. The reason assigned in the instant petition is that on 25.01.2024, C.M.P. No. 89 of 2019 was listed before the Bench and on the said date, the Court passed peremptory order by allowing one week’s time to remove the defects in the said C.M.P. 3. It is further submitted that inadvertently the petitioner could not comply with the order dated 25.01.2024 within the stipulated period, due to which on 01.02.2024, the aforesaid C.M.P. stood dismissed for non-compliance of order dated 25.01.2024. 4. It has further been stated that there was no intention on the part of the counsel or on the part of the petitioner and if the C.M.P. No. 89 of 2019 will not be restored, the petitioner will suffer irreparable loss and injury. 2026:JHHC:19390-DB 2 5. Learned counsel appearing for the opposite parties, is having no objection if the restoration application will be allowed. 6. This Court, after having heard the learned counsel for the petitioner, considering the submissions advanced by him and the reason assigned in the instant Civil Miscellaneous Petition, deems it fit and proper to restore the civil miscellaneous petition being C.M.P. No. 89 of 2019 which stood dismissed on 01.02.2024 for non-compliance of order dated 25.01.2024, to its original file. 7. In view thereof, the Civil Miscellaneous Petition being C.M.P. No. 89 of 2019 is restored to its original file, subject to removal of defect within two weeks. 8. Accordingly, the instant Civil Miscellaneous Petition stands disposed of. 9.
