Special Appeal Writ No. 1100/2025 Deepak Kashyap S/o Late Shri Sahib Singh, Aged About 40 Years, R/o B Narayan Darwaja Bheetar, Dheemar Mohalla, District- Bharatpur, Rajasthan. ----Appellant Versus 1. State Of Rajasthan, Through Secretary, Irrigation Department, Rajasthan, Secretariat, Jaipur. 2. The Chief Engineer, Bishalpur Project And Establishment (Non Gazetted), Water Resources Department, Rajasthan, Jaipur. 3. The Superintending Engineer, Water Resources Circle, Kota, Kota, Rajasthan. 4. The Executive Engineer, Water Resources Project Division, Bundi, Rajasthan. 5. The Assistant Engineer, Water Resources Project, Sub Division 2Nd, Gardada Dam Project, Bundi, Rajasthan. ----Respondents For Appellant(s) : Mr. Munesh Bhardwaj, Adv. For Respondent(s) : Mr. Vinayam Saran, Adv. Ms. Shruti Pareek, AGC Ms. Mansi Sharma, Adv. Ms. Mahi Choudhary, Adv. HON'BLE THE ACTING CHIEF JUSTICE MR. SANJEEV PRAKASH SHARMA HON'BLE MRS. JUSTICE SANGEETA SHARMA Order 12/01/2026 1. The present appeal suffers from delay of 625 days and is, therefore, time barred. 2. Application No.881/2025 has been filed under Section 5 of the Limitation Act seeking condonation of delay with the submission that the appellant could not learn about the decision of [2026:RJ-JP:1095-DB] (2 of 2) [SAW-1100/2025] the case. However, we find that such submission to be a bald excuse for not filing such an appeal for a period of almost two years. 3. The appellant challenges the order passed by the learned Single Judge whereby prayer for compassionate appointment was rejected on the ground of latches and delay. 4. Admittedly, father of the appellant-writ petitioner had expired on 06.02.2002, whereafter, he had applied for the job but he did not possess the requisite qualification for claiming appointment in Government Service. More than 21 years have lapsed since the death of his father. After considering the relevant law, the learned Single Judge has dismissed the writ petition. 5. We find that appeal is again being filed after much delay thus, no interference is warranted and the present special appeal is accordingly dismissed on the ground of delay as well as on merits. 6. All pending application(s), if any, also stand disposed of. (SANGEETA SHARMA),J (SANJEEV PRAKASH SHARMA),ACTING CJ HEENA/55
