[2026:RJ-JP:1267] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 11607/2025 Ramniwash S/o Hemraj, Aged About 30 Years, R/o Ajabpura, Tehsil Narayanpur, District Kotputli-Behror, Rajasthan. ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Kalyan Chand Surela Ms. Sushila Choudhary For Respondent(s) : Mr. Amit Punia, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 13/01/2026 1. The instant pre-arrest bail application under Section 482 of BNSS has been filed on behalf of the petitioner, who is having apprehension of his arrest in connection with FIR No.562/2024 registered at Police Station Pragpura, District Kotputli-Behror for the offences punishable under Sections 318(4) & 316(2) of BNS, 2023. 2. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He submits that although, there is allegation against the petitioner of inducing the complainant to transfer money into his bank account for securing the employment for the nephew of the complainant, no money was actually transferred in the petitioner’s bank account. Counsel submits that one agreement was also executed between the complainant and other co-accused person wherein it is mentioned that some amount was borrowed by the co-accused person from the complainant. It is submitted that petitioner has joined the investigation in terms of [2026:RJ-JP:1267] (2 of 3) [CRLMB-11607/2025] order of this Court dated 27.11.2025. Counsel further submits that custodial interrogation of petitioner is not required in this matter. In such circumstances, no fruitful purpose would be served by sending the petitioner behind the bar. Hence, this pre-arrest bail may be allowed. 3. Learned State Counsel opposes the bail application, however, learned State Counsel fairly concedes that as per investigation report, petitioner has joined the investigation and no amount was transferred in his bank account. 4. Considering the contentions put-forth by the counsel for the petitioner and taking into account the totality of facts and circumstances of the case, especially the fact that petitioner has joined the investigation in terms of order dated 27.11.2025, but without expressing any opinion on the merits/demerits of the case, this court deems it just and proper to allow this anticipatory bail application. 5. Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Pragpura, District Kotputli- Behror in FIR No.562/2024 is directed that in the event of arrest of the petitioner – Ramniwash S/o Hemraj, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties in the sum of Rs.50,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:- (i) that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to [2026:RJ-JP:1267] (3 of 3) [CRLMB-11607/2025] any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and (iii) that the petitioner shall not leave India without previous permission of the court.
