Kausik (Rejected) CRM (NDPS) 1647 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Egra Police Station Case No. 412/2024 dated 26.06.2024 under Sections 20(b)(ii)(c)/25/28/29 of the NDPS Act. And In the matter of : Mahabur Mandal @ Mahabur Mondal ……Petitioner. Mr. Arnab Chatterjee Mr. Avik Ghosh Mr. Abhinabha Mukherjee ……for the Petitioner. Mr. Bitasok Banerjee Ms. Sanjida Sultana ……for the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody since 1 year and 7 months and 215 Kgs. of Ganja were recovered from the joint possession of the petitioner and others. Learned advocate for the State opposes the prayer for bail and submits that witness action is about to commence. Having considered the quantum of seizure, I am of the view that rigors of Section 37 of the NDPS Act is attracted, as such the prayer for bail of the petitioner in CRM (NDPS) 1647 of 2025 is dismissed. 2 The learned Trial Court is directed to give priority to the seizure list witnesses and to complete their examination within the next 3 months. Petitioner would renew his prayer for bail after the said period is over. Learned advocate for the State would through the learned Public Prosecutor communicate this order to the learned Trial Court at the earliest. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
