THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DECLARE THAT THE FREEZING OF THE PETITIONERS ACCOUNT BANK ACCOUNT NUMBER BEARING 409002000757, MAINTAINED WITH THE 3RD RESPONDENT RBL BANK BY THE 2ND RESPONDENT WITHOUT FOLLOWING THE PROCEDURES CONTAINED UNDER SECTION 107 OF BNSS, 2023 IS ARBITRARY AND IS IN VIOLATION OF THE FUNDAMENTAL RIGHTS GUARANTEED UNDER ARTICLE 19 (1) (G) AND THE CONSTITUTIONAL RIGHTS GUARANTEED UNDER ARTICLE 300A OF THE CONSTITUTION OF INDIA, IN THE INTEREST OF JUSTICE AND EQUITY AND ETC.
THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING , THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

ORAL ORDER
1. The Petitioner is before this Court seeking for the following reliefs;
“A. Declare that the freezing of the petitioner's account bank Account Number bearing 409002000757, maintained with the 3rd respondent RBL Bank by the 2nd respondent without following the procedures contained under Section 107 of BNSS, 2023 is arbitrary and is in violation of the fundamental rights guaranteed under Article 19 (1) (g) and the constitutional rights guaranteed under Article 300A of the Constitution of India, in the interest of justice and equity. B. Issue a Writ of Mandamus or order or direction or any other appropriate writ to the 2nd Respondent to defreeze the Petitioner's bank Account Numbers bearing 409002000757, maintained with the 3rd respondent RBL Bank in the interest of justice and equity.

C. And grant such other relief or directions as this Hon'ble Court deems fit the
facts and circumstances of the case.”
2. A memo dated 02.06.2026 signed by the learned counsel for the Petitioner has been filed, which reads as under:
“MEMO FOR WITHDRAWAL FILED ON BEHALF OF PETITIONER It is most respectfully submitted that the respondent police has defreezed the account. Therefore, the petition/prayer has become infructuous. Wherefore it is most respectfully prayed to permit the petitioner to withdraw the petition in the interest of justice and equity.”
3. Accepting the said memo and submission of learned counsel for the Petitioner, the petition is dismissed as withdrawn.
4. In view of dismissal of the main petition, pending applications, if any, do not survive for consideration. Hence, the same are disposed.
