JUSTICE DEEPAK ROSHAN For the Petitioner(s) : Mr. Saurabh Shekhar, Advocate Mr. Anurag Kumar, Advocate For the Respondent(s) : Mr. Harsh Preet Singh, AC to GP-V -------- Order No. 4 /Dated: 23rd June 2026 The instant writ application has been filed by the petitioners for the following reliefs: “1.(i) For issuance of appropriate writ(s), order(s), direction(s), particularly a writ in the nature of mandamus, commanding upon the respondents, to implement the benefit of 7th Pay Revision Commission, in respect of the petitioners, who are the employees of different Madarsas of the State of Jharkhand, as also the Sanskrit High School, 2026:JHHC:18351 2 in the same manner as has been done in the case of other Govt. employees (including staffs of Govt. high schools/Govt. taken-over high schools) vide Govt. resolution, as contained in Memo No.8 (वि.1- 05/2002 (खण्ड) 380/ Ranchi, dated 05.03.2019; (ii) For issuance of appropriate writ(s), order(s), direction(s), particularly a writ in the nature of mandamus, commanding upon the respondents to release the entire benefits of 7th Pay Revision Commission and refund the salary of the petitioners to the upgraded replacement scales, to be granted w.e.f. 01.01.2016 and actual benefit to be given w.e.f. 01.04.2018; (iii) For issuance of appropriate writ(s), order(s), direction(s), particularly a writ in the nature of mandamus, commanding upon the respondents to make payment of arrears of salary in favour of the employees of different Madarsas and the Sanskrit High Schools, i.e. in respect of present petitioners; And/Or For issuance of any other appropriate writ (s) /order (s) / direction (s) for doing conscionable justice to the petitioners.” 2. A counter affidavit has been filed in this case wherein at paragraph nos. 8 and 9 it has been stated as under: “8. That it is most humbly and respectfully submitted that the proposal regarding the grant of 7th Revised Pay Scale to the teaching and non- teaching staff working in Non-Government Aided Madrasas and Non- Government Aided Sanskrit Schools is to be submitted for approval of the Cabinet through a detailed note (sanlekh) which has already been accorded by the Hon'ble Departmental Minister for further action. 9. That it is most humbly and respectfully submitted that further necessary action is currently underway in accordance with the prescribed administrative procedure. The completion of the entire process is likely to take approximately three (03) months time.” 3. Thus, after going through the specific averments made in paragraph nos. 8 and 9 it appears that for the prayer of the petitioners with regard to payment of 7th PRC in line of the State Government Teachers; the approval has already been accorded by the Departmental Minister and the matter is before the Cabinet for its concurrence. 4. Prima-facie it appears that the grievance of the petitioners has almost been redressed. 5. During course of argument, learned counsel for the petitioners submits that though the approval has been accorded for payment of 7th PRC but the applicable date from when it would be applicable has not been mentioned in the counter affidavit. Accordingly, he prays that after 2026:JHHC:18351 3 approval by the Cabinet; the claim for payment of 7th PRC shall be considered from 01.01.2016 as because the same is being paid to the other State Government employees. 6. Accordingly, in view of specific averments made in paragraph nos. 8 and 9 of the counter affidavit dated 19.08.2025, the instant writ application stands disposed of with an expectation that the Cabinet approval shall also be done shortly, but in any case, not beyond the period of 12 weeks. 7. So far as other prayer with regard to applicable date is concerned, the State Government should also consider the date of applicability with respect to payment of 7th PRC in the case of the petitioners like other State bodies. 8. Needless to say, after approval of the Cabinet the consequential benefit shall also be extended to the petitioners accordingly. 9. The instant writ application stands disposed of. 10.
