Bajaj Allianz Gen. Ins. Co. Ltd.  Vs  Kailash Kumar (deceased) through his LRs & Ors. CMP No. 19074 of 2026 in FAO No. 42 of 2018 05.08.2026 Present: Mr. Jagdish Thakur, Advocate, for the applicant/appellant. Mr. Sunil Kumar Ranta, Advocate, for the non­ applicants/respondents. The present application has been moved by the applicant, who had filed the appeal before this Court. The   said   appeal   was   decided   by   this   Court   on 03.03.2025, and the amount of compensation has been reduced. Now,   by   way   of   the   present   application,   a prayer has been made to release the excess amount, deposited by the Insurance Company. In   view   of   the   no   objection,   made   by   the learned counsel for the non­applicants/respondents, the application   under   consideration   is   allowed.     The authority, i.e. learned Civil Judge (Sr. Div.), Court No. 1, Shimla, District Shimla, H.P., exercising the powers of Commissioner,  Employees  Compensation,  with  which, the amount is deposited, is ordered to release the excess amount in favour of the applicant. The amount, so ordered to be released, shall be remitted   to   the   bank   account   of   the   applicant, particulars   of   which,   have   been   mentioned   in   the application.
