Accused in Crime No.29/2025 registered by Hosamane Police Station, Shivamogga, for the offences punishable under Sections 132, 351(2), 109, 121(1) of BNS, 2023 and Sections 3, 25(1B) of the Arms Act, is before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.29/2025 was registered by Hosamane Police Station, Shivamogga, for the offences punishable under Sections 109, 121(1), 132, 351(2) of BNS, 2023, against the petitioner herein based on the first information dated 21.02.2025 received from Krishnakumar.B. - Police Officer. 4. During the course of investigation, petitioner here was arrested on 21.02.2025 and subsequently remanded to judicial custody. Investigation of the case is completed and charge sheet has been filed. Bail application filed before the jurisdictional Sessions Court in S.C.No.5035/2025 was rejected on 03.12.2025. In the first information dated 21.02.2025 submitted by Police Officer of Hosamane Police Station, it is stated that petitioner is an accused in Crime No.22/2025 registered for offences punishable under Sections 352, 115(2), 118(1), 109, 351(2) read with 3(5) of BNS, 2023, and during the course of investigation of the said case, the police received a credible information that petitioner was present near a stone quarry in Halekachagondanahalli village. Therefore, the first informant and his staff had gone to the said place in a jeep. When an attempt was made to arrest the petitioner, he allegedly pulled out a dragger and tried to assault Adarsh - Police Constable attached to Hosamane Police Station and in the said incident, Adarsh had suffered simple injuries. Inspite of repeated warning, petitioner allegedly refused to surrender, and therefore, the first informant took out his service pistol and fired on the right leg of the petitioner, and thereafter, arrested him. Petitioner who has suffered grievous injury on his right leg was subsequently admitted to Mcghan Hospital at Shivamogga, and after recovering from the injury, he was remanded to judicial custody. - 4 - HC-KAR NC: 2026:KHC:26453 CRL.P No. 695 of 2026 6. Investigation of the case is completed and charge sheet has been filed. In the earlier criminal case which was registered against the petitioner, he has been already enlarged on bail. In the present case, petitioner is in custody for last more than one year. Considering the aforesaid aspects of the matter, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively, subject to appropriate conditions. Accordingly, the following order: 7. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.29/2025 registered by Hosamane Police Station, Shivamogga, for the offences punishable under Sections 132, 351(2), 109, 121(1) of BNS, 2023 and Sections 3, 25(1B) of the Arms Act, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 5 - HC-KAR NC: 2026:KHC:26453 CRL.P No. 695 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off; f) The petitioner shall mark his attendance before the Station House Officer, Hosamane Police Station, on the first and third Sunday of every month between 10.00 a.m. to 1.00 p.m., for a period of six months.
