[2026:RJ-JP:4466] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 11970/2025 Mahendra Singh S/o Dilip Singh, Aged About 29 Years, R/o Nayabas, Police Station Jeenmataji District Sikar (Rajasthan). ----Petitioner Versus The State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Surendra Singh Mr. Anup Kumar For Respondent(s) : Mr. Shree Ram Dhakhar HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 30/01/2026
1. Apprehending his arrest in connection with FIR No. 201/2025 registered at Police Station Sadar Sikar, District Sikar for the offences under Sections 8/22 of NDPS Act, the accused-petitioner has preferred this criminal misc. bail application under Section 482 of B.N.S.S.
2. It is contended by learned counsel for the accused- petitioner that petitioner has falsely been implicated in this case. There is no substantive evidence available on record to the fact that petitioner has supplied 15.20 grams of Mephedrone to the co-accused Sanjay. It is further contended that the other co- accused Sanjay has already been enlarged on bail vide order dated 11.09.2025 by this Court. The Petitioner is ready and willing to cooperate with the investigation, therefore, the anticipatory bail application of the petitioner may be allowed. [2026:RJ-JP:4466] (2 of 3) [CRLMB-11970/2025]
3. Learned Public Prosecutor has vehemently opposed the anticipatory bail application. It is contended that co-accused Sanjay in his disclosure statement furnished the name of the petitioner in supplying 15.20 grams of Mephedrone to him and apart from disclosure statement of co-accused, the petition was in direct contact with him. It is also contended that petitioner is a habitual offender and against him case under 19/54 of Excise Act was registered, therefore, considering the above facts the anticipatory bail application may be dismissed. 4. Heard and perused the material available on record. 5. The co-accused from whom below commercial quantity of contraband article- Mephedrone was recovered has already been enlarged on bail by this Court and apart from the disclosure statement of co-accused, there is no substantive evidence available on record, therefore considering the above facts, without commenting anything on the merits of the case, this Court deems it proper to enlarge the petitioner on anticipatory bail. 6.
Accordingly, the anticipatory bail application under Section 482 of B.N.S.S. is allowed and it is ordered that in the event of arrest of the accused-petitioner Mahendra Singh S/o Dilip Singh, in connection with FIR No.201/2025 registered at Police Station Sadar Sikar, District Sikar, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-
[2026:RJ-JP:4466] (3 of 3) [CRLMB-11970/2025] (i) that the petitioner shall make himself available for interrogation by a police officer as and when required; (ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or any police officer, and (iii) that the petitioner shall not leave India without previous permission of the court. (iv) that the petitioner would submit his Mobile phones and Sim Cards before the concerned Investigating Officer. (v) that the accused-petitioner would submit his contact details along with the present address to the concerned Investigating Officer. In case if the petitioner changes his address or mobile number, he shall submit the same before the concerned Investigating Officer. (PRAVEER BHATNAGAR),J RASHMI/ANMOL/22
