1.
Learned counsel for the petitioner after arguing the matter at some length made a limited prayer that since the respondents without issuing any show cause notice to the petitioner as regards the change of the category of the electricity supply connection have changed the category and made a demand, the petitioner may be permitted to make a representation to the respondents-corporation as regards his grievances of change of the category of the electricity supply connection and demanding the charges according to the changed category.
[2026:RJ-JP:12930] (2 of 2) [CW-5709/2026]
2. Taking into consideration the material facts of this case that no notice for change of category of the electricity supply connection is said to have been issued to the petitioner by the respondents-corporation, the Court feels that ends of justice would meet if the petitioner is allowed to make a representation to the respondents-authorities as regards his grievances pertaining to change of the category of electricity supply connection and demand of charges as per the changed category.
3. Accordingly, this writ petition is disposed of with the liberty to the petitioner to make a representation to the respondents-authorities within a period of ten days from today.
4. In case the respondents-authorities receive any such representation from the petitioner within above given period of ten days, the same may be considered and decided by the respondents-authorities after allowing an opportunity of hearing to the petitioner as early as possible by a reasoned and speaking
order.
5. Taking into consideration the overall facts and circumstances of the case, the Court also directs the respondents not to take any coercive action against the petitioner including the disconnection of the electricity supply connection till disposal of the representation, if the same is submitted by the petitioner within above given time of ten days.
6. In view of the order passed in the main petition, the stay application as well as pending application, if any, also stands
disposed of.
