KAMAL ORAL ORDER Learned counsel for the petitioners has filed a memo dated 01.06.2026 which reads as under: "MEMO The undersigned submits that he above petition is filed seeking relief of taking proper action against Respondent no. 3 and quashing/withdrawing FIR. The petitioner no.3 had already initiated separate proceedings in private complaint and the XXXII ADDL. Chief Metropolitan Magistrate Bengaluru, Honourable Court has already referred the matter to the jurisdictional police and they have field FIR in Crime NO.0307 of 2024 and the matter is pending under investigation against the 3rd respondent and others. 1 In Crime No.036 of 2023 was investigated and chargesheet was filed in SC No.1326 of 2023. The - 4 - HC-KAR NC: 2026:KHC:25643 WP No. 5577 of 2023 petitioners herein have filed an application seeking discharge and the said application came to be dismissed and against the dismissal fo the application a criminal revision Petition was field Crl.R.P.No.543 of 2025 and this Honourable Court has granted stay of the proceedings. Under these circumstances, the above petition does not survive for consideration. Hence the petition may kindly be dismissed as withdrawn with liberty to pursue the remedy in accordance with law in the interest of justice. Wherefore, the petitioners prayed for dismissal of the above petition with liberty as sought for in the interest of justice." 2. The memo is taken on record. 3.
