E ANJANA REDDY Counsel for the Respondent(S): 1. GP FOR WOMEN DEV, CHILD WELFARE The Court made the following: 3 Order:- The petitioner has challenged the order of removal dated 19.03.2013. This Court has suspended the operation of the said order and permitted the petitioner to continue in service as Anganwadi Worker, Teliki Village, Pedavaduguru Mandal, Gooty Taluk, Anantapur District. 2. The case of the petitioner is that she was selected as an Anganwadi Worker and that the petitioner claims to belong to the SC community; however, she was selected against a general vacancy. The respondents issued the impugned proceedings alleging that the petitioner submitted a fake SC certificate and that she deserves to be removed from service, the said proceedings are issued by the 2nd respondent. 3. The petitioner admittedly was appointed against a general vacancy and the submission of the caste certificate is of no relevance. Had the petitioner been selected in a post earmarked for scheduled category, and the allegation of submitting a fake certificate is made against the petitioner, the respondents would have been justified in issuing the impugned proceedings. 4. Considering the submission that the petitioner was appointed against a general vacancy, the alleged submission of the caste certificate claiming her social status as SC caste would be of no relevance. 4 5. Also considering the submission that this Court had granted interim orders on 01.04.2013, and that the petitioner is still continuing in service, no purpose would be served in passing any adverse orders at this length of time. 6. Accordingly, this writ petition is disposed of in terms of the interim order granted by this Court. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ____________________ JUSTICE HARINATH.N 03.02.2026 PNS
