The petitioner, through the medium of criminal Revision Petition, has assailed the order dated 11.04.2026 passed by the court of Principal Judge, Family Court, Jammu in a petition under Section 144 of the BNSS, 2023 granting interim maintenance to the tune of Rs. 9,000/- per month, in addition to Rs. 8,000/- already being paid by the petitioner under the proceedings of D. V. Act, thereby, fastening total monthly liability of Rs. 17,000/- upon the petitioner, in the order has been assailed on many courts. 2. Heard. Notice. 3. Notice is waived by Mr. Gagan Kohli, learned counsel for the respondent. Supp. Cause List-1 Serial No. 87 2 Crl R No. 42/2026 4. With the consensus of learned counsel for the parties, the petition is taken up for final consideration. 5. In the facts and circumstances of the case when the interim maintenance has been granted after a period of two years to the respondent, in the considered of this Court, Rs. 9,000/- per month as an interim maintenance appears to be on higher side as the respondent has already been receiving an amount of Rs. 8,000/- per month under D.V. Act from the petitioner. 6. On a consensus reached between the parties, the amount of interim compensation granted vide impugned order is reduced from Rs. 9,000/- to Rs. 7,000/- with liberty to the parties to lead evidence for and against in the main petition in the court below. 7. In view of the above, the impugned order dated 11.04.2026 passed by the learned Principal Judge, Family Court, Jammu granting Rs. 9,000/- as monthly interim maintenance in favour of the respondent herein is modified to Rs. 7,000/- only. 8. The criminal Revision Petition is, accordingly, disposed of, at notice stage, along with application(s).
