The instant petition is for the following reliefs:- “(a) Pass an appropriate order for Re-investigation/De-Novo investigating in the present case by transfer of investigation to Crime Branch or any other fair and unbiased competent investigating agency, directing them to investigate the present matter in a diligent manner and/or (b)Pass directions to the investigating agency to add proper sections as per law and/or (c) Pass appropriate directions to direct the Magistrate or an officer not less than the rank of DCP to monitor the investigation in the present matter and/or (d)Pass appropriate direction to the investigating agency to treat the present petition as a formal complaint by the petitioner regarding the murder of his son and lodge a F.I.R. and/or (e) Pass any other order in the facts and circumstances of the present case in favour of the petitioner, in the interest of justice.” This is a digitally signed order. Mr. Pradeep Rana, learned counsel appearing on behalf of the petitioner submits that the investigation was carried out behind the back of the petitioner and he was not heard. He also submits that the son of the petitioner has expired. According to him, if the petitioner is granted liberty, he would furnish the necessary reasons as to why the FIR No.1031/2021 should continue against proposed accused. 3. Bearing in mind the short submission and the fact that the cancellation report has not yet been accepted by the concerned Court, it would be appropriate to direct the petitioner to agitate all his grievances before the Court, where the cancellation report is pending for consideration. 4. Mr. Rana, at this stage, submits that the instant petition be treated as a protest petition. The said submission seems to be reasonable. 5. Accordingly, the instant petition is directed to be treated as a protest petition and the petitioner is directed to place the same before the concerned Court. The concerned Court is directed to treat the same as a protest petition and shall deal with the same in accordance with law. 6. With these observations, the instant petition stands disposed of. 7.
