Learned senior advocate appearing for the petitioner submits that the petitioner is in custody for 2 years 4 months and all the sections for which he is being tried are Magistrate triable offences. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. I find that the State has obtained a stay from the Sessions Court. The offences complained of are definitely very heinous offences, but at the same time the maximum punishment which can be imposed is for a period of seven years. Petitioner is in custody for more than 1/3rd of the period for which he may suffer sentence, if convicted. As 2 such, without entering into the merits of the case and having only taken into account the period of detention, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Arindam Roy shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judicial Magistrate, 18th Court, Calcutta. If on bail, the petitioner shall not leave the jurisdiction of the district of Kolkata without prior permission of the learned Judicial Magistrate and shall once in a fortnight attend the Officer-in-Charge, Hare Street Police Station who would depute a police personnel for acknowledging his attendance. The petitioner also on release will provide his available phone number(s) both to the Court as well as the police personnel who will acknowledge the attendance of the petitioner. Photostat copy of the order dated 20.03.2026 be kept with the record. The application for bail, being CRM (M) 2034 of 2025, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
