In this petition the petitioner is assailing the endorsement dated 13.10.2025 (Annexure-F) and the reply dated 04.02.2026 (Annexure-J) issued by respondent No.3, inter-alia sought for direction to respondent No.3 to carry out phodi and durasth in respect of the subject land, in terms of the order passed by this Court in WP No.18338/2025 (Annexure-E) disposed of on 06.08.2025. 3. Learned counsel Sri. K Gurudhatta, appearing for the petitioner submitted that the petitioner herein had purchased the land in question way back in 2022, however, the phodi has not been conducted and therefore, challenge has - 3 - HC-KAR NC: 2026:KHC:25713 WP No. 12838 of 2026 been made to Annexure-F to the petition. Accordingly, sought for time frame to conduct the phodi and durasth in respect of the subject land. 4. Per contra, learned HCGP Sri. Spoorty Hegde. N, sought to justify the impugned endorsement Annexure-F and contended that since it is a single window durasth has to be made in respect of the land in question and therefore, sought for dismissal of the petition. 5. In the light of the submissions made by learned counsels appearing for the parties, it is not in dispute that the petitioner herein had purchased the land in question as per the registered sale deed dated 27.05.2022 (Annexure-B). It is also to be considered that this Court in WP.No.18338/2025 disposed of on 06.08.2025 (Annexure-E), directed the petitioner herein to file necessary application seeking phodi and durasth in respect of the subject land and also directed respondent No.3 to consider the same within 2 months from the date of the receipt of the said order. 6. By taking into consideration the direction issued by this Court, I am of the view that the endorsement dated - 4 - HC-KAR NC: 2026:KHC:25713 WP No. 12838 of 2026 13.10.2025 (Annexure-F) does not survive for consideration as it is the duty of the respondents - authorities to conduct phodi and durasth in respect of the subject land. In that view of the matter the impugned order dated 13.10.2025 (Annexure-F) requires to be set aside and accordingly same is set aside in this petition. However taking into consideration the averments made in the writ petition, respondent Nos.2 and 3 are directed to conduct phodi and durasth in respect of the subject land in terms of the order dated 06.08.2025 in WP.No.18338/2025 (Annexure-E) in accordance with law with an outer limit of 6 months from the receipt of this order. In the event if the compliance of the order is not made, the same shall be viewed by this Court seriously. With these observations, the writ petition is disposed of.
