1. Heard Mr. N. Naha Roy, learned counsel for the applicant. Also heard Mr. G.P. Mathur, learned counsel for the respondent.
2. The present MCC has been filed for restoration of Miscellaneous Civil Case No.583 of 2025, which was dismissed for want of
2 prosecution by this Court vide order dated 08.08.2025.
3. Learned counsel for the applicant would submit that the present applicant had preferred a Miscellaneous Civil Case No.583 of 2025 seeking for clarification/modification of the order dated 22.04.2025 passed by this Court in WA No.259 of 2025 to the extent of reducing the amount of interest to be paid on the withheld amount of retiral benefits as it deems appropriate, but on the date of hearing, the counsel could not attend the Court, which was bonafide. Therefore, it is prayed that kindly allow the application for restoration of MCC No.583/2025.
4. Learned counsel for the respondent has no objection for restoration of MCC No.583/2025.
5. On due consideration and for the reasons stated in the application which is duly supported by an affidavit, we are satisfied that sufficient cause has been shown for restoration of MCC No.583 of
2025.
